CMC remand five persons for alleged culpable homicide and ordered their case file transfer to DPP

The Chief Magistrate court Number Six has ordered for the remand of five persons in Correctional Custody for allged Culpable homicide.
Chief Magistrate Godiya Bawa Gwani who gave the order held that the deffendant should be kept in the correctional facility and directed the Police Prosecutor Inspector Aliyu Malami,to forward the case file to the office of Director of Public Prosecutor (DPP), in the Ministry of Justice for legal advice.
The five deffendant were arraigned by the Operatives of the Anti Homicide Squad of the State Criminal investigation and Intelligent Department (SCIID) of the Niger State Police Command on four count charges which bothered on Criminal Conspiracy, Inciting Public disturbance, ocoursing hurt, and culpable homicide.
According to the Police Prosecutor, Inspector Aliyu Malami, the four count charges were punishable under section 97,114, 248(2), and 221 of the penal code law.
The charge sheet marked MN/ SMC/ CR/6/2025.made available in court and obtained by this reporter stated that one Abdullahi Walaci and eight others all of Gbachiku village in Lapai in Niger State jointly reported to Chief Magistrate court Number three Minna that on the 1st of January,2025, ” That you Bagudu Mayaki and five others now at large of Akwanu village in Agaie local government.
” You criminally conspired among yourselves with Dane guns Cutlasses and sticks and attacked them while passing through their village as a result one Usman Ibrahim,one Sani Usman,one Aminu Isah,Yunusa Umar,Ahmed Zakari, Musa Isyaku,Abdulkadir Saidu,Aliyu Ahmed and Mohammed Mohammed all of Gbachiku village sustained bullet injuries and they were rushed to General Hospital in Lapai and while one Ibrahim Walahi was rushed to Gwagwalada Specialist Hospital for treatment and doctor on duty confirmed him dead on arrival.
“While Aliyu Ahmed was admitted at FMC Bida was also confirmed dead on the 19th January,2025 as a result of the injuries sustained from the gun shots.
” Police Detectives swung into action and arrested you Angulu Mayaki and five others in connection to the case and during Investigation all the complainants identified you all to be among the persons who attacked them with weapons without any provocation.”
When the charges were read to the defendants, by the Presiding Chief Magistrate Godiya Bawa Gwani (Mrs) they all Pleaded not guilty.
The defense counsel to the defendants, Barrister Benjamin Adokwu applied for their bail by citing some Legal authorities that the defendants are all presumed innocent until the case against them were established.
While rulling on the bail application Chief Magistrate Godiya Bawa refused their bail on the ground that her court lack the Jurisdiction to grant bail on the case of culpable homicide punishable under section 221
And ordered for their remand in Correctional Custody till 24 of February 2025.
She then directed the Police Prosecutor to transmit the case file to the office of the Director of Public Prosecutor DPP in the state Ministry of Justice for Legal advice.
