Minna High Court ordered arrest of Managing Directors of stanbic ibtc, Mainstream Energy solutions and North South power company

Justice Mikailu Abdullahi of Minna High court number two has ordered for the immediate arrest of the managing director of Stanbic IBTC Bank, Mr Wole Adeniyi,  Engr. Olubumi Peters  Managing Director  North South Power Company and Engr. Lamu Audu managing director Mainstream Energy solutions.
Niger state Internal Revenue Service (NSIRS)  through its Lawyer  Barrister  Barrister Mohammed Kudu Ndayako SAN and Barrister Aliyu Ibrahim Lemu SAN has filed a direct criminal  summon against the defendants for their refusal to the plaintiff the revenue accrued
 Justice Mikailu Abdullahi who gave the order for their arrest following the submissions of the counsel  to the Plaintiff Barrister Ibrahim Aliyu Lemu SAN, told the court  to invoke warrant of arrest on the three defendants for their refusal to appear in court inspites several summons issued to them.
Barrister Aliyu Lemu SAN told the court that the North South Power Company  stanbic IBTC and Mainstream Energy solutions failure to demand for tax clearance certificate in respect of foreign  Exchange transactions contrary to section 85 (2) and (4) (d) and punishable under section 85 (9) of the personal income tax Act.
Wole  Adeniyi managing director Stanbic Bank Plc  and stanbic Bank Plc between the month of January 2022 and December 2023 at Minna within the Jurisdiction of ” this court, failed to request for the tax clearance certificate from the applicants for the issuances of certificate of foreign Exchange from your bank you thereby committed and offense contrary  to section 85 (2) and (4) (d) and punishable under section 85 (9) of the personal income tax.
The senior advocate told the court the defendants have severally refused to appear in court on several of them which necessitated ” our application for the issuance of warrant of arrest on them.
” Today the judge has graciously granted our application that the police Should go after them anywhere they are sighted. They should be arrested  and brought to court
. That is the position of the court today” he told Journalists.
The case has been adjourned to  Monday, June 10th 2024
