MINNA MAGISTRATE COURT FROWN AT THE POLICE FOR DISOBEYING COURT ORDERUTHMAN BABA- SIRAJDEEN
The Minna Magistrate court sitting in Minna the capital of Niger state has frowned at the Nigeria police force over the continued arrest and harassment of one Salisu Mohammed Dankabo even as the court has issued order restraining the police from arresting him.
Justice Mikailu Abdullahi had earlier ordered the Inspector General of Police (IGP), Kayode Egbetokun, the Deputy Commissioner of Police in-charge of FIB Tactical Squad DCP Bello Yahaya and Divisional Police Officer DPO in-charge of Mokwa Divisional Command CSP Wakili Inusa who are respondents in the suit to refrain from arresting the said salisu Mohammed Dankabo
The police in disobeying the Justice Mikailu Abdullahi court order still went ahead to arrest Salisu Mohammed Dankabo in a bank in Kutigi by officers from Kutigi Divisional Police Command in Niger state and whisked him to FIB office In Abuja.
Speaking with Journalists in Minna at the High court complexe on Thursday, Barrister Philip Emmanuel described the actions of the head of the FIB and the DPO Mokwa Divisional Command as contempt and abused of court order
According to the Legal practitioner, his client was arrested, detained and arraigned before a Minna Chief Magistrate court Nos 1 during a communal clash between Muwo and Tatabo community but was Exonorated via the legal advice from the office of Director of Public Prosecution DPP in the Niger state Ministry of Justice
According to the counsel” The Inspector General of Police was served the court order by the bailif of the court. He received the court order.
Continuing he said” The head of the FIB Tactical Squad refused to collect the order served on him while the DPO in Mokwa also refused to collect the court order,” he explained
” I will approach the court to file a contempt of court against the other two plaintiffs for them to show cause why they would not be charged for contempt” he told Journalists.
He said the continued arrest and detention of his client even with court orders is a violation of his fundamental right and his constitutional right of liberty calling on the Inspector General of Police IGP Kayode Egbetokun to prevail on his men to immediately release his client.
The legal practitioner advised during his chat with the Judicial correspondent at the High court complexe in Minna that all the institution concerned in the case involving his client should comply with the court order.
